Paternal Abortion Rights

Paternal fathers should have rights if the mother chooses to have or not have a child.

If the mother chooses to have the baby, the father can choose to not pay child support. If he chooses to not pay, he loses all rights and responsibilities to the child. He may petition the courts to get back rights, but shall be responsible for back child support for half the time from birth.

If the mother chooses to have an abortion, the dna must be taken from the fetus. The father shall petition the court before the abortion may request dna testing if he thinks he is the father and didn’t want her to have the abortion. The father may then sue for wrongful death.

Out of state abortions cannot be punishable in mother’s home state. The father may still sue for wrongful death and parental kidnapping.

Forced abortions shall be reported immediately. Doctors shall ask the mother if she is doing the abortion under her own volition or under duress. She shall be protected at all cost if answering yes to being under duress. If under duress, the father, if found guilty, shall be responsible for child support and all court costs. He will lose all custodial rights and it is up to the mother if and when he can be involved. If the mother is under duress by her parents or other person other than the father, that can be charged with attempted kidnapping and murder.

Forced abortion claimed after the fact. If it can be proven that the doctor failed to ask appropriate questions to make sure the mother was doing the abortion under her own volition and not under duress, then the doctor shall be responsible personally and not their practice. Can be charged as if the father, parent, or other person other than those.

If mother and father are agreeable to the abortion, they must complete an abortion prevention class and learn of all contraceptive options available that they should have used. If the contraceptive options were not available to them, they can be provided to them free of charge. They shall also be made aware of all options available other than abortion, including adoption. If adoption is chosen, it cannot be reversed, insurance companies shall pay for all medical costs associated with the pregnancy up until the adoption.

Abortions due to saving the life of the mother shall not pertain to this. Rape and incest, the victim shall have all rights. If victim is convicted of false reports, they shall be liable for all court costs and victim hood changes to the accused.
