2nd Amendment - ROLL BACK THE INFRINGEMENTS

We cannot expect the government to make laws that protect us - FROM ITSELF!

No government makes firearms laws, or stockpiles their own arms, to protect law abiding citizens. They do these things to protect themselves from us - which breaches the very core of our Constitution and risks the ruin of all else contained within it. Every law, rule, policy or government agency that places limits on the private ownership of any type of “arms” is a direct violation - an “infringement” to our constitution.

STEP 1 - ROLL BACK THE INFRINGEMENTS

  1. Dissolve the ATF as a government organization and revoke every Rule, Law, Act, or Mandate they created since the very beginning of operation.
  2. Repeal the 1968 Gun Control Act.
  3. Repeal all Federal, State and local laws limiting the use, or purchase of firearms or other handheld “arms” such as knives and swords as well as any associated accessories necessary to maintain and use such arms, such as ammunition, magazines, silencers, etc.
  4. Repeal the Gun Free School Zones Act of 1990, and all state carry laws that limit who can carry, or how you can carry arms.
  5. Repeal all laws that withhold gun rights from individuals convicted of non-violent criminal offenses.
  6. Disarm all non-military and non-police branches of the government and distribute all firearms and ammunition accumulated by such organizations, to the youth education programs listed below.
  7. Delete all current databases that collect any type of information that creates a connection between a firearm and the firearm owner. Make it a Federal Offense for any person, or government body to gather any information that could facilitate a future policy for the mandatory confiscation of firearms.
  8. Repeal all taxes on Arms, ammunition, and accessories associated with the use or manufacture such arms.

STEP 2 - FUND YOUTH EDUCATION AND TRAINING PROGRAMS

The foundation of responsible arms ownership, is education. Teaching firearms skills and safety at a young age lays the foundation for responsible ownership as an adult by fostering a culture of respect and teaching positive uses for firearms by engaging in competitive social programs. To accomplish this, we must add programs to the public school curriculum that can be taught by certified firearms trainers.

  1. Require Public Schools to teach a firearms safety course in 8th grade, and a firearms use and marksmanship course at some point between 9th and 12th grades. This curriculum is open to any child whether in public, private, or home education.
  2. Fund and promote local and national marksmanship competition in the Intramural sports programs in High School and Colleges.

Firearms ownership is the absolute bedrock of the American Constitutional Republic.

After witnessing the current rise of the Censorship State and the push towards worldwide Totalitarianism that we are experiencing today, it has become as clear today as it was when our founding fathers first wrote the Constitution in the 1700’s, that you cannot maintain liberty for the people unless you give them the right to fight to keep it, and that power requires weapons that are equal to those held by the Government.

Looking back at history, owning firearms is the only thing that separates our country (the American experiment) from every other country that has disarmed it’s population and then quickly degenerated into a Fascist Totalitarian regime that abuses it’s people for acts of non-compliance. There are no exceptions to this historical fact.

It is fair to say, the right to keep and bear arms should have been the 1st Amendment, because without it there is no such thing as freedom of speech, freedom to travel, freedom to own property, etc., all freedoms dissolve if you cannot defend your right to have them.

Do you have a guaranteed “Right” to anything?

The single most misunderstood concept about the US Constitution is that the rights granted in it are somehow GUARANTEED.

The truth is… there is no guarantee of Natural, or God Given, or even Constitutional Rights!

The concept that we are born into a world that automatically GIVES us something at birth, is very misleading. The “Bill of Rights” is the ultimate example of this fallacy because it claims to grant every human some kind of Rights. This seems amazing on the surface, but in function it is perhaps the most dangerous concept in our Constitution, because it pacifies us into thinking these rights are something each and every one of us OWNS, and it can’t be taken away.

The hard truth is that the Bill of Rights is just a piece of paper. Thinking it will protect you from a corrupt government is pure naivete that has been proven to be wrong time and time again throughout history and the only thing that transforms that scrap of paper into the reality we live in here in the USA, is that there are private, peace-loving individuals who are willing to fight to keep it in force.

The only thing any creature OWNS at birth, is the very temporary gift of the spark of life itself, and even that can be taken away because you only have the right to ATTEMPT to survive here on this planet. The universe doesn’t dole out manifest ownership to your right to have things like freedom, liberty and happiness like it says in our Constitution. Nor is there any God, or any Government, that can guarantee such rights.

The truth is that every government ever created began it’s first day in power by attempting to remove powers and rights from the people it was designed to protect, and that process of chipping rights away from the people and giving them to the government continues every single day.

Consider the phrase from our constitution which states, “the pursuit of” happiness. This is the most honest piece of the whole thing! This one phrase states the truth - that you have the right to “pursue” these things.

It is only through our own perpetual pursuit, that we might keep our rights.

Humans are a naturally tolerant species, capable of putting up with much abuse. But at some point in the progression of government overreach and abuse, there are those among us that will draw a line in the sand and say, enough!

Without the weapons of self defense, there is no amount of abuse that is too much, there is no line in the sand, and slavery becomes inevitable.

As we are pushed to the brink of Totalitarianism in our own time, the wisdom of our founding fathers becomes more and more clear as the words they wrote so long ago, once again become the key to the survival of this great country they started.

If we are to survive and thrive as free men and women in America, we must roll back every illegal act, rule, and law that violates the very simple and clear statement:

THE RIGHT TO KEEP AND BEAR ARMS SHALL NOT BE INFRINGED.

This simple statement is the backbone of the American society. Anyone who disagrees with this simple principle must accept that this is what America is.

I agree!!

How long did it take for your post to be approved?

Well done; however, I would suggest editing the title if you’re able. While reboot is correct term I took it as in redoing, revamping, changing, altering.
I whole hardly agree to both 1. And 2.

I wrote the exact same policy but yours is stated so much better than mine! Bravo! Im happy to see someone else posting the same issue. Thank you! Our rights shall not be infringed!!

You forgot a few things to help the 2A:

1.Repeal Gun Free School Zones Act
2. Establish Carry Reciprocity
3. Pardon people convicted of violations of gun law
4. Repeal machine gun ban in Firearm Owners Protection Act
5. Repeal Bipartisan Safer Communities Act
6. Immediate arrest of any local/state official that tries to take the guns
7. Engage with states to name official “state firearms” in the same manner they name state birds or state flowers

Justice Thomas stated the 2nd Amendment is just about guns, but anything you can hold in your hand. It’s not just for your house, your yard, or your town.
Remove All the Gun Restrictions, they are Unconstitutional.

I disagree with #4. We need armed police in order to protect law abiding citizens and therefore have the ability to defend against law breaking criminals and arrest them

You’re right, I’ll change that. I was thinking more like Parks Service and the Education department, and … the IRS.

I’ve been proposing we restore the militia to its proper place - https://forum.policiesforpeople.com/t/restore-the-militia/2010/1

Restore our gun rights in all states, citizens must have a right to bear arms, protect themselves, protect their families, defend and protect their property, constitution and freedom.

Absolutely! However there needs to be a couple of others;

  1. Any U.S. Citizen or group of citizens may purchase and own any weapon which is sold or given to any foreign nation to include tanks, airplanes, ships and missiles. (in other words, if it’s ok for the Taliban, it’s ok for me). Any weapon which may not be sold to a U.S. Citizen may not be sold to or otherwise transferred to a non U.S. entity or person.

  2. Any Government official who is found guilty of restraining the rights of a citizen or causing the restraint of those rights through a third party shall receive the death penalty. (this would negate the need for your #5 above)

Outstanding! I absolutely love this, i agree fully! I would just like to see that if people are able to go out and buy (grenades/mortars/rockets/etc…) before they can buy, they should have to take a simple 3-5 day course on safety, and how to use it. An affordable class at that maybe at the local gun range. Just so we can save some fingers/arms/legs. And if you are using them in an illegal manner or illegal reasons, once caught, death penalty, and not 20 years from that point, like days. Because no one cares about gun laws except your law abiding citizens because the punishments for them are weak. If they were strong punishments, the ones intending to do harm, might think twice

Thank you! I added a section on education programs after reading your reply. I haven’t added anything about punishments because that is outside the 2nd Amendment.
Trying to keep it as short and sweet as possible, although I think it’s already too long.

@R.S.Roe I can certainly see how this fits in well with the militia, and the militia certainly does require arms, but how do you think it could be used or added in to the 2nd in a way that further supports what I’ve got.
I like it, I just can’t see what to do with it.
Any ideas?

If we revitalize the militia of the several states according to my proposal, the extra-constitutional and unconstitutional agencies that have made it their mission to violate the second amendment would go away. With WE THE PEOPLE fulfilling our duty to “execute the law” and having primacy in that roll, it would be impossible for there to be a 2A violation going forward. The constitutional Militia of the several states is the insurer that ensures “the right to keep and bear arms shall not be infringed”. At that point if congress or states tried to pass anti-gun laws, we simple nullify them by not enforcing them.

basically our proposals should be rolled together. Mine focuses on the Militia and accomplishes what your aims are and where it might not be obvious to some (but is clear operationally in a causal chain) yours states in simple terms.

Let’s repeal the Lautenberg Amendment and replace it with a law that only removes a persons right to own and possess a firearm if a firearm was used intentionally to commit a crime. To lose a right for a misdemeanor crime is a blatant abuse of power and a direct attack against the Second Amendment. As it stands now, a person can not get their right to own a gun restored. If nothing else, the Lautenberg Amendment should be modified to a ban of no longer than 3yrs from date of offense and be automatically restored at that time. Many people lost their careers over this amendment including people who put their lives on the line for this country because they made that retroactive back to the beginning g of time. It is an injust purported against the American people. My bloodline derives two Presidents, John Adams, and John Henry Adams. They would be appalled at what this government has done against its own people. My wife is a descendant of Paul Revere. We have talked about the vision this country was founded on and what it has become today. It’s sad that there are those in this government who want to destroy this great nation from within and we believe EVERYONE has a right to protect themselves and put down a rogue government when it turns against its own people. The second amendment was designed exactly for that and it must be restored with the one exception of using a firearm intentionally to commit a crime.

Constitutional carry on a federal level. If you are a law abiding citizen you should be able to lawfully carry in any state.

The NFA itself must be repealed. Any restriction on the 2nd Amendment is an infringement. This includes civilian ownership of machine guns. Background checks can be kept, but as others have stated here there should be no lifetime ban on firearms ownership. There must be a path to restoration of rights.
