I could go on for hours about the ways police violate their oaths as well as our civil liberties, and how they truly need more training in Constitutional clauses, de-escalation and just general social interactions, but it all boils down to one simple fix: end qualified immunity for cops.
They get a blanketed free-pass on violating our laws, and it needs to stop. Cops should not be allowed to lie or falsify to citizens, cops should not be able to abuse lawfare and make the process the punishment, and cops should not be able to rely on tax-payer money to bail them out when they willingly violate someoneâs Constitutional rights.
Law enforcement should be required to buy their own insurance like doctors do, only instead of malpractice it is for Civil Rights violations. Only when they are responsible for their own actions, financially as well as professionally, will they stop trampling on We, the People.
For anyone interested, there is a plethora of 1st Amendment Auditor content on platforms like Rumble and Youtube, and while there are SOME who do it in bad-faith just to sue cops, there are others such as Lackluster Media, Audit the Audit and Honor Your Oath who are professional and do a great job exposing the lack of training with both police AND government employees who do not understand or appreciate our Constitutional rights.
Most people, especially the âback the blueâ crowd, would be outright astounded at what law enforcement gets away with in regards to violating our rights, and then WE end up having to pay for the lawsuits. It needs to stop.
Qualified immunity ONLY applies if 1) the police officer(s) are acting in accordance with the law, and 2) are acting within the policies and procedures of the jurisdiction (city, county, state, etc.) they are employed by. If any action by a law enforcement officer does not meet BOTH of these requirements, they do not receive qualified immunity.
Please donât waste everyoneâs time with this nonsense. You might as well just suggest disbanding police departments.
As for me, Iâd like to see America return to some semblance of the Rule of Law. That will require an effective police presence.
Thatâs the way itâs supposed to work, but it doesnât.
Take Honor Your Oath for instance. Heâs a retired veteran who goes to various states and cities on the east coast and simply stands outside government buildings like city hall holding a sign that says âGod Bless Homeless Veteransâ. Thatâs it. He is polite, says âhelloâ and engages people to pray for homeless veterans, and they consistently call police on him and say he is panhandling or asking for donations ( which he never does ), ect. The cops cite city statues that say this is against the law, but our Supreme Court has ruled that panhandling is a ârequest for charitable donationsâ and is thus covered by the 1st Amendment.
And yet he is constantly trespassed from PUBLIC property ( which is also against the law ), harassed, IDâd and even arrested despite everything that he is doing being covered by our Constitutional rights. And when he wins these cases, do the cops pay? No, it comes out of the city fund.
Other infringements on our rights that auditors constantly face is video-recording in public, in government buildings like post-offices and court houses ( ALL legal and covered by our Constitution ), and the response from ignorant citizens and law enforcement is often infuriating.
Covering your eyes and pretending that everything works as-intended is insane, especially in this current climate. I urge you to do some research, educate yourselves on how widespread this problem is.
Tell that to the People who have had their Faces busted wide open, got Knocked unconscious, and had to have surgery because the cop was power Tripping, or was a Rookie, and again, Power Tripping, or ran their car into a Bicycle, or a pedestrian, and again, Power TrippingâŚ
Did I mention cops tend to go on Power Trips???
Nope, Law and Order is good, but thatâs NOT what they teach at the Academys, the only things they teach anymore is Power Tripping, and how to look up Commercial Violations Codes, and they wouldnât teach the last part, but ââQuotasââ, Iâm sure youâve had to meet at least a fewâŚ
Qualified Immunity is the Reason why Politicians go on power trips and abuse their Employees, but also get uppity with the Public, or will yell at us and it helps them when they DO Break the Law, it also opens the Door for Judges to abuse their Powers on and Off the Bench, itâs why they can get away with getting Drunk and then getting into an accident, itâs the Reason why Cops Slam people against walls or floors and tend to do very real damage to peoples Bodies but mainly their Head and FaceâŚ
A legal doctrine that protects government officials, including police officers, from personal liability for constitutional violations unless they violated a âclearly establishedâ constitutional right.
Suing police officers
Suing police officers can be difficult and time-consuming. The plaintiff must win every appeal to hold the officer liable, and the officer gets three appeals while most defendants only get one.
Examples of qualified immunity
The Supreme Court granted qualified immunity to an Arizona police officer who shot a mentally impaired woman four times. The court ruled that the officer had not violated âclearly established lawâ.
Exceptions to qualified immunity
Qualified immunity doesnât apply to criminal charges or prosecutions.
Indemnification
Police officers are often indemnified, meaning they are not responsible for settlement payments or jury-awarded damages.
When a lawsuit is won by someone who was injured by the police (which means someoneâs constitutional rights were infringed) it is often (or always) the police department (our own tax dollar), who ends up paying for the damages. That needs to end. If a cop infringes someoneâs rights, they are doing it willing fully and knowingly, and they should absolutely be personally responsible.
I agree that power corrupts. The Stanford prison experiment shows how reasonable people become monsters without realizing it.
Suing individual officers will lead to unintended countermeasures by the Unions and acab friendly judiciaries.
A free market solution already exists. Individual insurance policies similar to a public sector bond. Too many claims, that LEO will be dropped from coverage.
Like every proposed solution there will be countermeasures employed by those who wish to sow division. This proposal would avoid turning bad cops into full time professional court witnesses while taxpayers foot the bill.
Summary: neuter union bosses. Bond/ insure individuals.
