Do away with the HOA

Do away with the Home owners Association. People buy houses to own them not to have people like those in the HOA micro managing what you do with your own lawn or with your own home. They have to many restrictions in communities with the HOA program. Some say you can’t have a USA Flag or, or your porch can’t be but a certain size. People are paying enough for their homes and don’t need the added cost or hassle of the HOA knocking on their front door or harassing them.

You don’t have to live in a neighborhood that has an HOA. But people who want to live in a neighborhood with an HOA have a right to form associations to maintain common areas and set the rules for living there.

If people want to have them then have them all be state regulated so the hoa bored can’t end up stealing your house just cause you paint your house the wrong colors or you have your car in your drive way to long

Exactly. I’ve heard of a police officer currently fighting with the HOA because he parks his patrol car in the driveway. They want to fine him because he does. That’s crazy in my opinion.

State issue, not federal government. Look at what voters in MO just did in this past election. Talk to your state legislatures

If people want to buy a home within an HOA or are just looking, documents regarding the HOA’s specific rules, regulations, and policies, should be given to the buyers either during the initial tour of the home or when they want to put in an offer on the home to ensure they are capable of complying.

I believe that if you buy a house in an HOA area, you should be able to opt out of the hoa

Congress is the only body that has the Constitutional Power to make laws and they cannot delegate that power without a clear legislative mandate. Since executive agencies cannot set policies and rules without a “clear constitutional authorization” according to West Virginia v. EPA , 59 U.S. 697 (2022) and Loper bright Enterprises v Raimondo , 603 U.S. 369 (2024) (0verturned the Chevron Doctrine.), it would seem that HOAs would also fall under those restrictions. Especially, when they are taking property without due process of law. It would seem that HOAs ruling making “authority” would also be null and void.

Ok what happens now? Alot if good information but how do we move forward to get thd hoas out or at least investigated? I had a fire in my condo. Its been 1 yr and 10 months and hoa barely has some work done. They are micro managing the monies. I cant complain to contractors board because i did not hire them. I can only complain to real estate division but they are swamped and kust refer for you to get a lawyer.

I am forced to still pay 300 hoa fees which were raised twice in last 3 years and they want me to get renters insurance when i have no personal effects in the home.

Hoa president does fine owners and takes homes away. She owns 20-30 units in the property. I told her i didnt want her in my property and she told ne “if i was dying of thirst, she wouldnt give me one drop of water!” . I lost everything and to have to fight the hoa to get back into my home is ridiculous .
