Abolish Property Taxes

States are mandated to follow the Constitution and Bill of Rights.

  • Fourteenth Amendment: This amendment, ratified after the Civil War, is the key legal mechanism expanding the Bill of Rights protections to state actions through the “incorporation” process via the “Due Process Clause”, meaning states cannot deprive individuals of “life, liberty, or property, without due process of law.”

  • Fourth Amendment: This amendment, ratified on December 15, 1791. “ The Fourth Amendment of the United States Constitution protects the people from unreasonable seizures by the government:

  • Protections
    The Fourth Amendment protects people’s “persons, houses, papers, and effects” from unreasonable searches and seizures. The landmark Supreme Court case Mapp v. Ohio in 1961 established the Fourth Amendment applies to the states. Ongoing property taxation effectively nullifies citizens security of home ownership.

Taking property for unpaid taxes is definitely unconstitutional! And the Supreme Court agreed 2 years ago with a unanimous decision in Tyler v. Hennepin County, which ruled that home equity theft qualifies as a taking under the Fifth Amendment
Many rural area local governments don’t know this or they hope you don’t. But if they take it they got to pay you for it, excluding the back tax owed!

The system is corrupt, if we own the equipment is not right to be charged every year, period! otherwise why own the equipment? minus well rent it, but then again when i had a satellite broadband dish system here even that is residential the charged “property tax” on it too. Totally unjust!

You should consider talking to your neighbors and running for counsel whichever government is charging you those outrageous taxes I don’t know how yours works we have very low ones charged by our borough might be called accounting in your area but I don’t have any state ones yeah I paid $250 a year for 27 acres. So look at which part of government is charging you that much your city your Barrow county or parish or is it your state government. If it’s your borough county or parish then run for office. Eliminate that property tax cuz I am sure everybody who’s paying that kind of property tax that’s crazy that is really crazy the point of buying so you can have it paid off in your old age and not have that massive bill requiring you to go to work until death. There are other ways to raise funds for programs and there are programs that need to be eliminated. Sales taxes are the best idea.
You could go to your council members are alderman and say hey here is a better idea we know we have to have some taxes to pay for services so, if you must have property taxes, then only do them for a set number of years. That way you don’t have a bunch of elderly flooding in because you have zero property taxes. That will give people incentive to buy and stay because if they buy and stay then they’ll be property tax free after so many years.

Totally agree. Property taxes are a constant, an individual’s life circumstances are not. At the drop of a dime a person may become ill, lose employment, or experience a life changing event, and without warning their finances get turned upside down. The government holds our feet to the fire whenever it comes to their money. You fell on hard times, FU! Didn’t have a backup plan, FU! Can’t pay your taxes, FU!

House prices are so crazy high where I live in CA that even if you though you “bought” a house with cash you are really renting from the government. Property taxes on a new house can be $2,000 a month which is as much as rent in other places. If you owned a house a long time, you taxes can be lower, but still higher than a similar house in many other states. If you try to fix up your house, your taxes go up as well.

HOAs are a type of property tax in and of itself. And, if you really dig up tax regulations you might find that HOAs are NOT constitutional! When you depend on someone else to tell you to mow your lawn(HOAs)you just gave up a freedom!

Just one of the price tags for a Communist state! You live in California!

HOAs are not as bad as local government as you can and should read the bylaws before you buy and there are plenty of houses without HOAs. Nearly all are non-profit and some can save you money. They can negotiate for pool care or lawn care at a better rate. You share would be much lower than if you had to pay individually for pool or lawn care. Of course, if you are a DYI type you will pay more, but most people appreciate the convenience. I once was in an HOA that had a huge TV antenna and routed cable to all the houses. When cable TV came to town, they negotiated a very good group rate for all of us. Cable was in our HOA fee.

Tax is legal extortion. Like gangsters collecting protection fees.

You state the absolute fact, mvnguyen. Anyone familiar with the underworld knows the game. The American people have been bled dry — no blood left in this collective turnip…there is nothing left here --look around. It’s time to bust up this mafioso extortion game and reconfiscate the wealth stolen from us in order to save America. All of the wealth is on the OTHER side of the table. The “monopoly” game is OVER. What is left but to flip the table and change the rules, for, ‘We The People’? What is left to do? Cry and mourn? Die, en masse? No need for revolution…this can be done properly, without firing a single shot. We are Americans, after all, representing the greatest country on earth. :us:

And STILL after you pay your property in full, you STILL have to pay taxes. We never own our property, “their” hands are always in our pockets!

I absolutely agree personal property taxes for a homestead should be banned by federal law. Those taxes are particularly hard on elderly folks who live on a fixed income. When they’ve already paid for many years, it is morally wrong to jeopardize their security (of having a home) over ever-increasing property taxes when they already bought and paid for their home and property out right.

Anybody who suggests you try to work with state and local officials over property taxes (since it is not a federal issue) is thoroughly misleading you; and nothing will come of it. For example, you wouldn’t go to the fox that sits atop your henhouse and ask the fox to stop eating your chickens, would you? Of course not…you go get a mean dog to run off the fox. Same here. You go through the court system and have courts order the states to strike down their own unconstitutional laws.
