Purpose: To amend the current calculation of disability ratings for veterans to ensure that a veteran with a combined disability rating of 100% receives full disability compensation.
Section 1: Amendment to Title 38, United States Code
(a) Current Calculation Method: The Department of Veterans Affairs shall discontinue the current method of calculating combined disability ratings, which often results in veterans receiving less than 100% compensation despite their total disability ratings.
(b) New Calculation Method: If the total combined disability rating of a veteran equals or exceeds 100%, the veteran shall receive 100% disability compensation. This applies regardless of individual disability percentages and their combined effects.
Section 2: Implementation
(a) The Department of Veterans Affairs shall revise its regulations and guidelines to reflect this change within 180 days of the enactment of this bill.
(b) The Department shall provide clear communication to veterans regarding the new calculation method and ensure that all claims are processed according to the new guidelines.
