User Agreement Free Choice Act

In an increasingly digital age, we have become more reliant on cloud software services and applications to hold vital information, documentation, pictures and important intellectual property. Contributing users should always have access to their systems in a simple manner and not be restricted by user agreements or accepting terms where goalposts are moved and rights to privacy and protection have to be violated or forfeited in order to gain access to these systems. All too often I have come to find terms of service being updated and your only option is to accept or not be able to continue working or accessing your user information, applications, phone, photos, documents and other important information.

This act would look to place restrictions and implement guidance on the ability to change the terms of service with users while using applications, products or services. If a consumer has engaged or contracted in a product they shall have the ability to continue with that product or version of an application unless the current version creates an undue burden or risk on the company or user.

Changes to user acceptance shall also not restrict from ones ability to access their information, pictures, data or anything else that otherwise may be inhibited in the past and used to create duress in forcing one to accept their new terms of service in order to continue to operate or access the product, information or services needed.

Any changes in terms of service should have a summary written in layman’s terms showing and explaining the explicit changes from the prior terms of service for the user agreement while limiting the language to one page in legible size 12 font LIMITTED TO ONE PAGE. There should also be reporting for companies who choose to update their terms of service midstream informing consumers of their reputation, how often they push these user agreement changes and if they have restricted access to user information in order to hold hostage the ability to use the service or product.
