Unconstitutional Zoning Laws

All Americans have the God-given right to Life, Liberty, and the Pursuit of Happiness. Many Americans who already own their own land and personal property would like to pursue their own businesses, yet cannot because of purposely designed zoning laws that restrict or forbid the building, buying, or selling of resources because of zoning restrictions. For example, someone with land zoned agricultural cannot build and operate a business on it without permission from the county, even though the person owns the land outright. Local and municipal governments should NOT have the right to restrict private property use that inhibits the property owner from becoming a positive contribution to society. Although States may create laws that are not already codified by federal laws, states should not and MUST NOT be allowed to restrict private property usage (and pursuits thereof), which was originally enshrined in the constitution as PROTECTED private property. Thus, zoning laws that, for no good constitution-supporting reason, simply STOP its owners from being productive on their own lands, should be ruled as unconstitutional, and federal action should be taken to penalize states who infringe on constitutional rights of the property owner to do as he pleases on it, with no harm to others, and for the betterment of society as a whole.

Although there’s a wild variation in federal District court interpretation, I have great confidence in our Supremes to overturn significant unconstitutional laws from state and local governments.

Of course, preemptive strikes against foolish and stupid decisions would be ideal!
