Suspension of International Travel Privileges for USAID and NGO Employees Implicated in Fraud, Waste, or Abuse

AUTHORITY:
Pursuant to the authority granted to the Secretary of State under the Passport Act of 1926 (as amended), including 22 U.S.C. § 211(f), and consistent with the provisions of the Immigration and Nationality Act, this directive is issued to protect the integrity of federal resources and the interests of taxpayers. The government’s power to regulate the issuance and revocation of passports, as established in precedents such as Kent v. Dulles, 357 U.S. 116 (1958), and Afroyim v. Rusk, 387 U.S. 253 (1967), supports the imposition of travel restrictions under circumstances that affect national interests and public welfare.

ORDER:

  1. Passport Suspension:
    Effective immediately, the passports of all employees of the United States Agency for International Development (USAID) and of all employees of nongovernmental organizations (NGOs) are hereby suspended until further notice.

  2. Scope of Application:
    This suspension applies to any such individual for whom evidence or reasonable suspicion exists regarding complicity in fraud, waste, or abuse of federal funds—including, without limitation, the misuse of taxpayer resources and time.

  3. Travel Restrictions Pending Investigation:
    Any individual meeting the criteria set forth in paragraph 2 shall be precluded from departing the United States. Such travel restrictions shall remain in place until a comprehensive and thorough investigation has been completed and the individual’s involvement in the alleged misconduct has been adjudicated through appropriate administrative or judicial processes.

  4. Due Process Considerations:
    All actions taken pursuant to this order shall be implemented in full compliance with constitutional due process requirements. Affected individuals shall be afforded any statutory rights of appeal or review as provided under applicable law.

  5. Duration and Review:
    This order shall remain in effect until such time as further notice is issued by the appropriate authority. Reviews of this directive, including any necessary modifications or revocations, shall be conducted in accordance with established legal procedures.
