Adds additional language to the “Privileges and Immunities Clause of the Constitution” protecting citizens who travel from their home state with an abortion ban to another state without a ban and receives abortion services.
A state with an abortion ban shall not be able to criminally charge a resident for seeking and obtaining an abortion outside of their home state.
The right to travel is protected by the Privileges and Immunities Clause of the Constitution and is rooted in the Articles of Confederation and the Magna Carta. The Supreme Court has ruled on cases that affect the right to travel, including Hendrick v. State of Maryland, Shapiro v. Thompson, and Sáenz v. Roe.
I don’t think any states actually have any laws which criminalize women for traveling out of state for an abortion.
BTW, I have also created a detailed proposal to address the top concerns that people have about state pro-life laws and abortion. Would you please consider it?
FYI - the very first paragraph summarizes the whole idea, and the actual content of my proposal comes after a few disclaimer paragraphs/my MAHA letter
There are currently no bans that would require the travel protections I noted and our laws currently protect this action of our citizens. My suggestion to add protective language is a way to help ease the fears that a lot of women are having.
