Penalties for Trespassing into the USA (Illegal Imigration)

Instead of immediate deportation of illegal aliens, have a system in place that tries and convicts them of breaking entry laws. Then impose prison sentences for at least two years. More depending on other circumstance and for repeated offenses. This will stop their ability to enter again or back to work for criminal organizations. It will also allow time for investigators to uncover illegals who may have been involved in other crimes and we will still have them in custody. Once they have served their sentences then they will be deported.

How do we pay for the prisons?

Do they get a jury, an attorney?

If so, how do we pay for that?

If not, how fair will the trial process be?

How do we pay for the prisons? We are paying much more for continuous redeportation of the same individuals. They would be adjudicated which means that they would not be eligible for release until they fulfill a work program that would generate revenue for the federal government.

Do they get a jury, an attorney? No, they are either a citizen or not. Anyone alive today that is a native or naturalized citizen would have an easily accessible record of their citizenship.

If so, how do we pay for that? It’s not done through the courts so there’s nothing to pay for in that regard.

If not, how fair will the trial process be? Again it’s not a court proceeding so this is mute.

Of course there would be a much more detailed process and procedure for this. The point I am making is that we are now just taking them over the border and releasing them to just start their process of returning. Also, once they are released in another country we lose jurisdiction over them if it is later found that they are suspected of an additional crime. Often illegals will use ICE and Boarder Patrol to help them get out of the country quickly before it is detected that they are suspects. Also adding a component of a jail sentence to the risk of trespassing into the USA will likely deter the broader population of illegal aliens. The more logical people wanting to come into the USA might consider spending two years waiting to go through the legal process rather than risking getting a two plus year sentence and then not being eligible at all.
