Bill to Prevent the Banning of TikTok

Section 1: Short Title
This Act may be cited as the “Freedom of Online Expression and Data Security Act”.

Section 2: Findings

Congress finds the following:

(1) The First Amendment of the United States Constitution guarantees the freedom of speech and expression.

(2) The internet has become an essential forum for the exercise of these freedoms, with social media platforms playing a significant role in how Americans communicate and consume information.

(3) TikTok, a popular social media platform with over 150 million American users, provides a unique space for creative expression, communication, and access to diverse viewpoints.

(4) A ban on TikTok would disproportionately impact young Americans, who comprise a majority of its user base, and stifle their ability to engage in online discourse and access information.

(5) While concerns about data security and potential foreign influence are valid, a complete ban on TikTok is an overly broad solution that infringes upon the First Amendment rights of millions of Americans.

(6) Less restrictive measures, such as data security audits, transparency requirements, and content moderation policies, can address these concerns without resorting to an outright ban.

(7) According to a Pew Research Center study, 32% of American adults get their news from TikTok, highlighting its role as a significant source of information.

(8) A ban on TikTok would set a dangerous precedent, potentially enabling the restriction of other platforms based on their country of origin or content, further eroding online freedom of expression.

Section 3: Prohibition on Banning TikTok

(a) No federal agency may take any action to ban or otherwise restrict access to TikTok within the United States without a court order based on clear and convincing evidence that the platform poses a direct and imminent threat to national security.

(b) This prohibition applies to any action taken by a federal agency, including but not limited to:

(1) Issuing an executive order.

(2) Promulgating a rule or regulation.

(3) Entering into an agreement with a foreign government.

(4) Taking any other action that has the effect of banning or restricting access to TikTok.

Section 4: Data Security and Transparency

(a) To address concerns about data security, TikTok shall be subject to regular audits by independent cybersecurity firms to ensure compliance with industry best practices and U.S. data privacy laws.

(b) TikTok shall provide transparent reporting on data collection and usage practices, including information sharing with foreign entities, to ensure accountability and user awareness.

Section 5: Repeal of Existing Bans
Any existing federal law, rule, regulation, or executive order that bans or restricts access to TikTok is hereby repealed.

Section 6: Severability
If any provision of this Act is held to be invalid, such invalidity shall not affect the remaining provisions of this Act.

Section 7: Effective Date
This Act shall take effect immediately upon its enactment.

1000% on all of this.

Also we mustn’t forget that a significant percentage of Americans have created businesses, whether content creation or selling of products and goods via the TikTok shop, on the platform. An all out Ban would have a detrimental chain reaction of American citizens losing another (or their sole) source of income that no other platform has been able to replicate, which would be bad for our economic growth and expansion!

Praying for an overturn as we speak :crossed_fingers::weary::crossed_fingers:

You are totally correct! So we can also add the following to it:

Section [Number]: Economic Impact and Mitigation
(a) Findings:
Congress finds the following:
(1) TikTok has become a significant platform for American entrepreneurs, content creators, and small businesses.
(2) A substantial number of Americans generate income through TikTok, either through content creation, online commerce via TikTok Shop, or affiliated marketing.
(3) A ban on TikTok would result in the loss of income and economic opportunities for many Americans.
(4) The unique features and reach of TikTok have not been replicated by other platforms, making it difficult for affected individuals and businesses to transition seamlessly.
(b) Economic Impact Assessment:
(1) Before enacting any legislation that would ban or significantly restrict access to TikTok, the Secretary of Commerce shall conduct a comprehensive assessment of the potential economic impact of such action.
(2) This assessment shall include, but not be limited to:

  • The number of Americans who use TikTok as a primary source of income.
  • The estimated financial losses for individuals and businesses.
  • The potential impact on related industries and the overall US economy.
  • An evaluation of existing alternative platforms and their capacity to absorb the economic activity displaced by a potential ban.
    (c) Mitigation Plan:
    (1) Based on the findings of the economic impact assessment, the Secretary of Commerce shall develop a mitigation plan to address the potential economic losses resulting from a TikTok ban.
    (2) This plan shall include:
  • Programs and resources to support affected individuals and businesses in transitioning to alternative platforms or economic activities.
  • Initiatives to foster the growth of alternative platforms that can provide comparable economic opportunities.
  • Measures to ensure the continued growth and vitality of the digital economy in the United States.
This section aims to ensure that any decision regarding TikTok takes into account the potential consequences for American businesses and individuals who rely on the platform for their livelihood. It emphasizes the need for a thorough economic impact assessment and a mitigation plan to address potential losses.
