Hate Speech laws

I think we need to address the whole idea of hate speech.

It sounds really nice to be against hate. Everyone can agree it’s not nice to be hateful and hateful speech is the worst. That’s a wonderful subject to virtue signal about- it’s very hard to exactly nail down what it is, so you can apply it at will, but it sounds very bad and therefore anyone condemning it must be a good person and of course correct in their conclusions (honest).

However, to try to make hate speech illegal has opened a real can of worms. Ultimately, we’re trying to legislate niceness, and you have no legal obligation to be nice. I hope no one will ever feel hate in their heart for their fellow man (that means human beings), but you have the right to do it.

What you do not have the right to do is to call for someone to be harmed, for example, for any reason that I know of. But that is already a law. Enforce the law we already have, please, and that solves that problem.

Otherwise this leads to thought crime. To enforce a law against hate speech requires assuming you know what the person feels and intends, and you don’t. You simply can’t. And there is no reason beyond virtue signaling and political posturing that we would need a law against hate.

The law has always been, as I understand it, that you can think and feel whatever you please and it is no one else’s business. You have the right to be hateful. You have the right to be a racist even. What you don’t have the right to do is to break the law. The law governs your actions not your feelings or thoughts. Those are your own. And if you’re the biggest most hateful racist on the planet the rest of us have the right to not like you. Maybe we won’t talk to you. Maybe we won’t choose to go to your store and buy your merchandise, for example. Maybe we’ll mutter amongst ourselves how cruddy it is to be like that person. Hopefully you will feel our disapproval and change your ways. But you’re free to be that way until you break the law, and expressing your hateful ideas or even racist ideas is not a crime. Free speech allows for all of that until you call for harming someone and even then, it’s the call to harm someone, not your emotional basis for doing so, that is illegal.

Please stop trying to legislate people’s feelings, thoughts, and niceness level. It’s illegal, transparent manipulation, being used as a basis for political censoring which I think most of us would be happy to do without once we really think it through.
