Americans should have the right operate a vehicle and travel non-commercially without a drivers license. We have the right to travel but every state breaks the constitution currently by enforcing a driver’s license to drive a vehicle down the road.
You are absolutely correct. A drivers license is only necessary for commercial driving and not for personal traveling.
Driver’s licenses are compulsory adhesion contracts and violate our right to free non- commercial travel within the U.S. Oftentimes, the state “governments” aka public corporations use the drivers’s license to compel or prohibit certain acts of its holder not related to driving whatsoever unconstitutionally (i.e. paying child support).
The 10th amendment has entered the chat. Driving is a privilege, not a right. People are free to move about their lives, but, it’s not unconstitutional to make people carry a license to operate a motor vehicle. No license is needed to walk anywhere.
Licenses may be required to drive or operate a motor vehicle but cannot be required for travel in a carriage of whatever carriage type it might be.
Fair enough, so anyone who wants to drive without a license should probably go to the carriage dealer. Don’t forget the extended warranty, although you’ll still receive the calls.
I agree, but driving is commercial and so is a motor vehicle. Traveling freely in a personal automobile is a right we have. A private automobile under UCC codes is classified as consumer goods, which you may not license or be forced to register.
I’m sorry but the 10th amendment is pretty clear.
You have a right to the freedom of travel but, no where in the constitution does it say that you have the right to travel by motor vehicle. It would never pass legal muster in court to try to argue that a person can without the necessary registration and insurance and license. Although I would tend to agree that there should be more lax laws…I’d never want to be on the road with someone who is operating a motor vehicle without proper training, and insurance if they decide they want to do something stupid and hit my vehicle that I worked hard for.
most consider it a birthright nowadays
The right to travel is inalienable right, correct.
But the driver’s LICENSE is just that, the license, as it involves lives and wellbeing of others who might be affected/injured/killed by an action of uneducated/non-skilled/ignorant/arrogant “operator of a motor vehicle”.
In fact, these current “driving licenses” are given away, practically, not earned - and one can see the results of in on our roads and highways every single day.
And if you’d look at what educational procedures and requirements exist in, say European (way safer roads with present driving ethics even in the cities) countries, you’d be shocked - they not only study the first-aid basics but also the general vehicle mechanics in order to obtain AN AMATEUR Driver’s License !
