The Obama admin altered the Equal Access to Justice Act to allow environmental lobby groups to “recoup” highly inflated cost of attorney’s fees by “nudging” state or federal land development projects. By “nudging” it is meant that a multifaceted suit need only to prevail on a single issue (no matter how minor) to allow them to seek attorney’s fees from federal funds. Environmental groups use this act, which was designed to give poor land owners the ability to fight land development projects that would involve their land. It is used as a back door funding mechanism for extreme environmental lobbies who fund left leaning politicians. Among other unintended consequences.
End this loophole and allow only land owners being affected by state or federal development to recoup attorneys fees.
