Policy Name: Parental Freedom in School Enrollment Act

Purpose:
To protect parental rights in health care decisions while ensuring access to education for all students, regardless of vaccination status.

Section 1: Policy Statement

  1. The United States of America recognizes the right of parents and guardians to make health decisions for their children.

  2. Public and private schools may not deny enrollment based on a student’s vaccination status.

Section 2: Definitions

Vaccination Status: The medical record of immunizations received by a student.

Parent/Guardian: A legally recognized individual responsible for a minor’s welfare.

School: Any public, private, or charter institution providing K-12 education.

Section 3: Implementation Guidelines

  1. Prohibition of Discrimination: Schools shall not:

Refuse enrollment based on vaccination records.

Segregate or stigmatize students due to vaccination choices.

  1. Parental Choice: Parents/guardians have the right to opt-out of state-recommended vaccinations for personal, medical, or religious reasons without penalty.

  2. Public Health Measures:

Schools may provide optional vaccination programs and education for those interested.

In the event of an outbreak, unvaccinated students may be temporarily excluded from attendance to protect public health, subject to due process and reasonable accommodations.

Section 4: Legal Protections

  1. Parents and guardians are protected from prosecution or administrative penalties for choosing not to vaccinate their children.

  2. Students shall not be subjected to punitive actions, including suspension or denial of access to extracurricular activities, due to their vaccination status.

Section 5: Transparency and Education

  1. Schools shall provide unbiased, evidence-based information on vaccinations to help families make informed decisions.

  2. Schools shall clearly communicate any public health policies, including procedures during disease outbreaks.
