Birthright citizenship is not a ā€˜policyā€™, itā€™s a (bad) interpretation of the 14th Amendment. The 14th Amendment was created to give citizenship to former slaves, not for anyone who flops their baby-maker across the border and pinches out a kid three seconds later, and as absurd an example as that may be, technically that kid would be a citizen.

The Supreme Court needs to interpret the amendment correctly, recognizing the language ā€œSubject to the jurisdiction thereofā€. Only a child born of two natural-born citizens should be given automatic citizenship. A single non-citizen parent would not qualify, though it could be expedited for citizenship recognition though I believe it should be dependent on whether or not the child has lived in the United States for an overwhelmingly significant portion of their childhood. The single-citizen loophole is abused by China to create, for lack of a better term, ā€œsleeperā€ agents who all are completely Chinese and live in China and have zero connection to America, but have American citizenship allowing them to enter and apply for government jobs and security clearances.

You might be familiar with the single-parent citizenship law as it changed in the 1980s and a certain former president had more than a few questions concerning his citizenship status and birth certificate for that reason.

Some say that the 14th amendment is being misinterpreted. Others disagree, and this is opinion handed down by the Supreme court years ago.
Regardless, a constitutional amendment can fix this.
Here is a draft.
ā€œNo person shall secure the right of citizenship solely by being born within the territory of the United States.ā€

Get rid of birth right citizenship. If you are born here to illegals you should not be granted citizenship. You are a citizen of your parents homeland.

Iā€™d say make it a requirement that one parent has to be a citizen and the other has to be a legal resident. That would probably fix the whole ā€œillegal alien babyā€ problem while incentivizing people whoā€™ve married abroad to bring their spouses here.

Birthright Citizenship is called STATE Citizenship and is part of the U.S. Constitution, and just because we arenā€™t allowed to use it correctly due to the 14th Amendment and ITS Naturalization Clause that makes everyone into U.S. Citizens, doesnā€™t mean we should get rid of Our Most Natural Status, as we might just get to return to it once again, and leave all the TAXATION Behindā€¦

What you might be meaning is to Ban Anchor Babies, and 14th Amendment Naturalized Citizenship, and THAT is something I can fully supportā€¦

As a LEGAL immigrant and Naturalized citizen, this is a great idea.

However, i need to askā€¦what should be done with a permanent legal alien adult who gave birth to a child in the country, then the adult becomes naturalized, would the minor be auto inducted as well or would the child be required to apply when he/she turns 18yo?

If you legitimized, then the same option should be applied to your offspring. This country is not unwelcoming of immigrants, only law breaking migrants. Alas, I can only speak for myself.

I 100% agree. Too many people receive benefits from the government because of those kids. There should also be laws against that.

Agree. We the People do not discriminate Legal and Honest intentions or actions. We do abhor and reject illegal ppl, acts, and the like. I asked so we can consider the depth of the situation we want to remedy.

I would say children born in the US will not be granted citizenship unless one or both parents are citizens or both parents are legally in the US on a long-term basis (I.e., green card)

The 14th Ammendment has been misinterpreted and abused and needs to be brought in line with itā€™s orignal intent.

To allow it to be used to confer citizenship on the children of foreign nationals is treasonous!

I believe that this should be reformed to make it birthright citizenship for children of legal citizens who have been properly vetted and naturalized. I also believe the immigration system needs reform, but thatā€™s a whole other topic.

I agree with most of this but me being a citizen here, and I have a baby with my immigrant spouse, I want my kid to be a citizen here. I think 1 citizen parent should be enough. Thatā€™s my situation too, Iā€™m engaged to a foreigner and we are doing immigration the legal way for her, and we plan to have children. They will be mine and they should be citizens too. The baby obviously wonā€™t be concieved overseas, but for both parents to be foreigners having a baby here should not allow the baby to automatically become a citizen.

Sadly with 10,000,000 million new illegals, this will hurt America. The numbers are just mind bugling.

I agree. Iā€™m fine with giving birthright citizenship to children born to people who are here legally. However, those born to people who are here illegally should not be citizens and the entire family should be deported and made to go through the legal process. (IF we need to reform the legal process and make it easier for some people, then thatā€™s a different discussion.)

This is a great start but Iā€™m a natural born citizen to generations of natural born citizens, yet your suggested wording would imply Iā€™m not a citizen because I was born here. Maybe add something about generations of natural born citizens? Or generations of citizens?
