Eminent Domain and Citizen Property Rights

  • Land use on federal lands must be in concert with citizens’ rights and state consent.
  • Energy is allowed to be extracted on public lands as long as the environmental conditions are in alignment with proper safety standards and national energy needs.
  • Eminent domain must be approved by state and local communities. Only for national defense can the US Government assert eminent domain with complete transparency and coordination of local and state representatives.

Property tax responsibility for individual/personal land and home will end after 10 years of ownership. It is the intent that the American Citizen who purchases their land and home actually own their personal property. Continual taxation allows both the State and Federal Government loopholes into eminent domain and foreclosure actions due to current excessive taxation on citizen land when the citizen reaches retirement age or personal health issues that prevent the citizen to work to pay property taxes and not able to do so. This allows state and federal entities to seize/re-acquire land. Also, fully owned land is allowed to be inherited by direct family members either through a Will, Power of Attorney or other legal process. Since the land already had taxes paid from landowner, the family of the deceased landowner shall NOT bear responsibility of new taxation of the property if kept within the family of the deceased.

Excessive Federal land ownership must end and homesteading rights be re-established and affirmed by law.
Re-affirm that NO foreign national or foreign government or business entity shall be allowed to own ANY property of the United States and its territories.

Are you wanting to change the government’s ability to use eminent domain only for National defense, or are you saying that’s all they can use it for. Currently the federal government can use eminent domain for just about anything at once and unless your state has set up rules for their use of imminent domain they can pretty much do the same as long as it has some benefit to the public. As far as property taxes the that’s local and you and your local politicians decide on your property taxes. The Supreme Court unanimously decided last year or the year before that a home seized for back property taxes or properties for back property taxes is a taking and a violation of the fifth Amendment not all areas in the United States know this yet and many of them are probably just hoping that you don’t but yes if they seize your property for back taxes when they sell the properties they’re only due to the property taxes and that’s it not the whole amount they sell it for that goes back to the original owner.

National defense is the only course of eminent domain that would not require state, local or property owner permissions, although coordination at state and local level with property owner is the most respectful for the landowner. But, I would further state that Congress would have had to officially declare war in order for those chain of events to occur.

That would not be hard considering we’re always at war with someone
