The fact that so many people have come here illegaly in the last 4 years should tell us that their children should not automatically be citizens, even if they were born here. Chain migration can result.
Might need a Constitutional amendment for this one. Wikipedia says,

I had an mri done and was told it was all good. I found out many years after having the mri done that I had numerals on my thyroid, I was told that they didn’t tell me about it because that wasn’t what they were looking for. Now how’s that right!
The clause “… and subject to the jurisdiction thereof…” has been interpreted as only pertaining to being subject to criminal law. That is an incomplete interpretation. The clause means that the person is considered to “belong to that nation” - has national membership in that country and receives the protection of that country.
An example to understand this - is when a foreign alien commits a crime in the US. He serves his time here, and then is deported to his home country. If he was an US citizen, he could not be deported.
If this entire sentence is applied properly, then when a foreign national gives birth in the USA their child is not a US citizen, but rather is a citizen of the country to which the parent belongs.
We’ve been improperly allowing these people to claim citizenship when they do not have it.
I agree that this would be essential for our country to succeed. We cannot reward others for breaking the law when our own citizens are held to a standard. We must set an example to the rest of the world. Also we should implement a system were they are offered an opportunity to successfully obtain citizenship legally.
We have a system in place to apply for legal immigration status here. The ones that come in illegally must follow it just as the legal immigrants do. No special favors for people who do not follow the rules.
I understand that we do, there should be one for the DACA kids that had no choice in the problem. I fully support doing everything legally by the legislation placed for legal immigration. There just needs to be a better way to not over complicate things the “government” way. The rules and regulations should be in plain English for everyone to understand and be able to apply without needing a lawyer to explain the terminology.
If someone robs a bank to pay for their child’s college education, the children do not get to keep the money.
Why should a child be rewarded for their parents crime? In this case Illegal immigration.
I completely agree with that, especially having working with BP while in the military and seeing what actually happened there.
There does need to be something that is in place, for instance they are sent back to their families home country while waiting for their packet to be processed and approved.
There has to be an idea that works for both sides as these kids only know what it’s like to live in America.
If an illegal alien commits a crime in America they should be deported immediately. Why should we spend thousands of dollars to keep him locked up. Savings right there. They have already committed a crime by entering our country illegally. Thus the term “illegal alien.”
Here Here, they come here pregnant with that idea in mind to obtain citizenship by design.

There should be some revocation to this if the parents came into the country illegally.
Then why do the states issue a birth certificate to the child. There should be a different document issued to the illegal child to the illegal parent to take back to their own country.
“Subject to the jurisdiction thereof,” means child born on our soil from Diplomats, tourists, and illegal aliens do not count under this statement.
I agree that the birth certificate for the children of foreign nationals should be different than the one issued for US citizens. That would certainly make it easier for everyone to know what they are dealing with.
Since county clerks and public health departments issue those certificates, the standards for training of the clerks needs improvement. Congress should pass legislation that details the standard that should be held before birth certificates can be issued.
Just enforce the constitution and case law!
LOL Read section 5 of the 14th Amendment. All we need is for CONGRESS to grow a spine and pass a law clarifying the intent of section 1: to whit: If you are born of an US citizen, then you are a US citizen of natural birth.
We already have laws that detail how a child of a US citizen born abroad gets their citizenship recognized. And yes! A child of a US citizen born abroad is a US citizen.
