WE THE PEOPLE
PROTOCOL
When, in the course of Presidential Elections, the winning candidate receives from the voters a mandate, that is winning the popular and electoral numbers, this shall be considered the law of the will of We the People.
This law takes its force from the clause in the Declaration of Independence that our government, and its elected officials, derive their power to govern exclusively from the consent of those they govern.
Another way of expressing this idea is, “Your (the elected official’s) authority is what we (We the People) say it is.” There is no other case in which a Constitutional Republic can exist and thrive. The current state of this nation is evidence of this fact.
The current convention of elected officials and un-elected bureaucrats giving We the People options they prefer for choices in matters of governing this nation fails this test.
The correct approach is we tell you what we want and you make what we want happen.
Elected officials presenting those who elect them with limited options is tantamount to passive totalitarianism. Passive totalitarianism is infringement and/ or encroachment of or on the rights and freedoms of We the People without threat of force or violence.
The effect of passive totalitarianism is indistinguishable from aggressive totalitarianism which is loss of rights and freedoms at gun point.
The passive effort omits the gun but leaves only two bad choices for We the People. This is as unacceptable as facing a weapon. There is no option afforded those who are governed. The elected officials bypass what the will of We the People has obviated as the path forward for this nation as a single unit.
It is not that the offending elected official(s) and unelected bureaucrats do not recognize the mandate, it is that they refuse to comply with it. This is repugnant to the will of We the People as expressed by voting the mandate. The mandate is the evidence of the will of the people.
If we do not have teeth in the enforcement of the consent of the people clause, the rest of the Declaration of Independence, Constitution, and Bill of Rights is meaningless.
We have experienced in this election cycle the censoring of speech. No one has been held accountable for this Constitutional violation because there are no teeth in the consent of the governed clause.
To amend that error, restore accountability to elected positions as well as un-elected bureaucracy positions, and ensure the integrity of public office, the following measures shall be enacted. These measures shall be known individually and collectively as “The Contempt of We the People protocols.”
Protocol One: The consent of the governed is the root of all legal authority in the United State of America.
Protocol Two: If there is ever a question about what the consent of the governed means it shall be considered with emphasized respect for what measures, initiatives, platforms, and/ or campaign promises earned the voters of votes.
Protocol Three: If there is ever an elected official or elected officials who speak, act, or seek support to deny, defy, or defect from the mandate of We the People, then the Supreme Court of The United States of America will immediately review the public record of the vote count, the public record of measures, initiatives, platforms, and campaign promises of the candidate receiving the mandate.
Protocol Four: If the review of the public record reflects that elected officials alone or in concert are speaking, acting, or seeking support in opposition to or to otherwise deny, defy, and/ or defect from the mandate of We the People, then the Supreme Court of the United States of America shall immediately find the elected official(s) doing so in Contempt of We the People.
Protocol Five: Upon a finding of Contempt of We the People, by operation of law, immediately, in all the Jurisdiction of the Supreme Court of the United States of America, each and every elected official subject to the finding shall be stripped of all legal authority effective the moment the finding is made.
Protocol Six: Once the finding of Contempt of We the People has been made, the subject elected official(s) will be void of authority to act in any public capacity. Any order they issue will be an unlawful order. No person shall be obligated to comply with such illegal orders.
Protocol Seven: Once the finding of Contempt of We the People has been made, the subject elected official(s) shall forfeit any and all pay, perks, pensions, and protections of elected office.
Protocol Eight: Once the finding of Contempt of We the People has been made, the subject elected official(s) shall bear financial responsibility for all fees, costs, and expenses necessary to make whole We the People.
Protocol Nine: Once the finding of Contempt of We the People has been made, no person shall lend aid, abet, or comfort the subject elected official(s) in any manner or capacity under penalty of conspiracy to commit Contempt of We the People.
Protocol Ten: Any person not serving in the capacity of an elected office who incites, promotes, funds, or otherwise facilitates or attempts to facilitate any speech or action which is intended to cause or implement Contempt of We the People shall be guilty of conspiracy to commit Contempt of We the People and be immediately subject to the forfeiture and seizure of all assets and holdings.
Protocol Eleven: Any un-elected bureaucrat who redirects legislative intent, participates in corporate capture of government agencies or programs, and/ or who cannot account for taxpayer funds entrusted to them, shall be considered in Contempt of We the People. Such persons shall be immediately relieved of their positions, stripped of all authority, and be financially responsible for all fees, costs, and expenses incurred to make We the People whole.
Protocol Twelve: Anyone found to be in Contempt of We the People shall be barred from public service for life.
Protocol Thirteen: Anyone found to be in Contempt of We the People shall bear financial responsibility for making the victim(s) of the contempt whole.
Protocol Fourteen: All funds, assets, and holdings recovered under the Contempt of We the People protocols shall go to fund the restoration of the victims of the contempt.
Protocol Fifteen: These protocols for Contempt of We the People shall not be amended, changed, or infringed by any means except a 75% voter approval in each of the several states of the United States of America to be accomplished in one voting cycle.
These protocols for Contempt of We the People put on notice all those who would govern that it is our power before we entrust it to you. You enjoy the privilege we allow you. We reserve the right to snatch back our trust the moment we detect untrustworthy activity. We will in no way be denied, defied, or defected from by our elected officials and other public servants.
This is the last line between competing interests and conflict. We need not tell you twice. We the People have spoken, and we will not suffer stifling, stumbling blocks, or delaying tactics. It is our mandate. Do as we have told you to.
