Constitutional Governance Requirement for Federal Funding of Private Businesses Act
Section 1: Title
This Act may be cited as the “Constitutional Governance and Public Accountability Act of 2025.”
Section 2: Purpose
The purpose of this Act is to ensure that private businesses receiving federal loans or grants uphold the principles of the United States Constitution, particularly with respect to protecting free speech, and to establish temporary public oversight of such businesses as a condition of federal funding, with the option to restore private rights upon repayment of funds.
Section 3: Definitions
(a) “Private business” refers to any corporation, partnership, sole proprietorship, or other entity engaged in commerce that is not wholly owned by a government entity.
(b) “Federal loans” refer to any financial assistance provided by the United States government in the form of repayable funds.
(c) “Federal grants” refer to any non-repayable financial assistance provided by the United States government at the time of disbursement, though subject to voluntary repayment under this Act.
(d) “Constitutional governance” refers to the operation of a business in accordance with the rights and principles enshrined in the United States Constitution, including but not limited to the protection of free speech under the First Amendment.
Section 4: Eligibility for Federal Loans and Grants
(a) Constitutional Governance Requirement: Any private business applying for or receiving federal loans or grants must agree, as a condition of funding, to govern its operations in a manner consistent with the United States Constitution. This includes, at a minimum, ensuring that employees, customers, and stakeholders are afforded the right to free speech equivalent to that guaranteed under the First Amendment.
(b) Public Property Designation:
(1) Upon acceptance of a federal loan, a private business shall be designated as public property for the duration of the loan repayment period, operating under federal oversight to ensure compliance with constitutional governance standards.
(2) Upon acceptance of a federal grant, a private business shall be designated as public property, subject to the same oversight, until such time as the full amount of the grant is voluntarily repaid to the United States government.
(c) Restoration of Private Rights:
(1) A business that has received a federal loan may regain full private property rights and autonomy upon full repayment of the loan, provided it has complied with the constitutional governance requirement throughout the loan period.
(2) A business that has received a federal grant may regain full private property rights and autonomy upon voluntary repayment of the full grant amount to the United States government, provided it has complied with the constitutional governance requirement during the period of public designation.
Section 5: Enforcement and Oversight
(a) The Department of the Treasury, in coordination with the Department of Justice, shall establish regulations to monitor and enforce compliance with this Act, including procedures for businesses to repay grant funds and restore private rights.
(b) Businesses found to violate the constitutional governance requirement shall be subject to penalties, including but not limited to repayment of funds with interest, loss of eligibility for future federal funding, or additional public oversight measures.
Section 6: Effective Date
This Act shall take effect 90 days after its enactment into law.
