Combating Deportation Resistance

Governor Newsom of California, Governor J.B. Pritzker of Illinois, Mayor Eric Adams of New York City have all pronounced their intent to fight any effort by President Donald J. Trump to carry out mass deportation of illegal aliens. I suggest the Trump DOJ, begins preparations to charge those Democrats and any other Democrat with numerous charges, such as:

Obstruction of an Official Proceeding: Over January 6th 300 defendants have been charged with this felony for their role in disrupting the certification of the electoral votes, which was an official proceeding of Congress.**

Seditious Conspiracy: This severe charge was leveled against leaders of extremist groups like the Proud Boys and Oath Keepers. For instance, Enrique Tarrio of the Proud Boys received the longest sentence at 22 years. Stewart Rhodes of the Oath Keepers was sentenced to 18 years for leading a coordinated effort to overthrow or obstruct the government.

The legal premise for potentially charging a sanctuary city or state official with being an accessory to a crime involving an illegal alien largely revolves around federal statutes concerning immigration enforcement and the harboring or shielding of undocumented immigrants. Here’s how this might be considered:

8 U.S.C. § 1324 - Bringing in and Harboring Certain Aliens:

This section of the United States Code criminalizes actions that facilitate the illegal entry of aliens into the United States, their transportation within, or their harboring or shielding from detection after illegal entry. Specifically:

Harboring: Subsection 1324(a)(1)(A)(iii) makes it a crime to “harbor, conceal, or shield from detection, such alien in any place, including any building or any means of transportation.” An official in a sanctuary jurisdiction who knowingly assists or encourages an undocumented immigrant in a way that could be construed as harboring might fall under this statute.

Accessory After the Fact:

Beyond direct violations of immigration law, officials could also potentially be charged as accessories after the fact under 18 U.S.C. § 3 if they assist someone who has committed a crime to evade arrest or prosecution. If an undocumented immigrant commits a crime and a local official’s policies or actions prevent law enforcement from apprehending that individual, this could be interpreted as aiding in the evasion of justice. Any Democrat involved in protecting illegal aliens who rape, murder, rob, assault, or commit any other violent crime should be charged as Accessories After the Fact.

Obstruction of Justice:

While less directly applicable, if a state or local policy or action by an official is seen as obstructing federal immigration enforcement or judicial processes, they might face charges under obstruction of justice laws, though this would be a broader interpretation and likely depend on the specifics of the case.

Section 1373:

This section prohibits local governments from restricting the sharing of immigration status information with federal immigration authorities.

Prepare a RICO (Racketeer Influenced and Corrupt Organizations Act) for aiding and abetting drug and human trafficking cartels,

Existence of an Enterprise:

RICO requires that there be an “enterprise,” which is defined broadly to include any individual, partnership, corporation, association, or other legal entity, and any union or group of individuals associated in fact although not a legal entity. This could include a city or state government if their policies or actions form a pattern of activity that supports or facilitates the criminal enterprise of cartels.

Obstruction of Justice: If local policies obstruct federal law enforcement efforts to investigate or arrest members of drug cartels, this could be seen as racketeering activity.

Aiding and Abetting: If sanctuary policies are interpreted as intentionally aiding or facilitating criminal activities (like harboring individuals known to be involved in cartels), this could also qualify as racketeering.

The American people DEMAND a secure border! Sanctuary cities and states undermine the rights of every American and violate the national and local security of every American. They should pay a price for that.
