Birth Right Citizenship

Whereas Congress has the authority to enforce the provisions under Section 5 of the 14th Amendment. Accordingly: the meaning of the term “subject to the jurisdiction thereof.“ as stated in the 14th Amendment of the US Constitution does not apply to individuals who have entered the United States illegally.

Individuals entering the US illegally are NOT US Citizens.

Such Individuals are subject to deportation from the United States. While in the United States they are Wards of the Federal Government and can be prosecuted under any Federal, State or City Laws and can be jailed awaiting trial or can be incarcerated for such crime or can be remanded to the US government for deportation to their own country of Citizenship or such other Country that will accept them.

Wards of the Federal Government, individuals illegally in the United States and foreigners on temporary visa status Shall NOT be counted in the census for the purposes of allocating House of Representatives seats in Congress .

A State can not be compelled to incur cost nor infringe on State resources by individuals illegally in the US or are Wards of the Federal Government.

A State or Local agency is entitled to seek reimbursement by the Federal Government for any costs incurred as a result of individuals illegally entering the United States. However, no claim shall be valid against the Federal Government in the event that the State or local agency thwarts the turn over of such illegals to the Federal government or does not cooperate in identifying individuals illegally in the United States.

Newborns and Children of:

  1. individuals illegally in the United States
  2. Wards of the Federal Government
  3. Individuals who are on temporary visas
  4. or have a temporary status in United States
  5. Or have Diplomatic Status
    retain the citizenship status of their parents.

A Naturalized Citizenship is defined as a child born to a US Citizen Father/Mother regardless of the place of birth or an individual who has Legally entered the United States and has obtained US Citizenship legally.
