You can't sue for damages, if you suffer losses while committing a crime

with so many local laws being enacted by (liberal included) local legislatures - it is so easy to commit an “unlawful activity” even by simply standing for your constitutional rights… not a solution IMHO

Actually, this entire proposal is pointless, the only case in which a ‘trespasser’ could sue is if they were injured by a ‘dangerous condition’ on their property, without proper notification. Meaning no traps, if you know they’re coming just call the police. In states with a castle doctrine, you might as well just shoot an intruder. If your state doesn’t have a castle doctrine…why not? I don’t understand how you would think you would survive a home invasion otherwise, it’s not like the cops are gonna be there for 15min at best anyway.

Otherwise homeowners have no obligation to protect someone trespassing.

Not true there have been multimillion dollar lawsuit cases where a burglar fell from a window and became injured and sued for loss of income, pain and suffering.

I would say booby trapping would be perfectly okay if you have a fence.

Yes. That includes illegal entry into our country.
