There is precedent with many federal transportation mandates requiring states to comply in order to receive funding. States are currently required to have a DUI legal BAC limit of .08 to operate a
Motor vehicle, states are free to elect not to abide by this mandate; however they do not receive their federal transportation funding.
Illegal imagrants operating a motor vehicle pose a significant hazard to the general public. Like the DUI program, states have the opportunity to voluntarily participate in efforts with the federal government. Should states not participate or actively oppose, interfere or hinder deportation efforts of illegal individuals by the federal government, those states would not be eligible to receive federal transportation funding.
