Strip powers of regulatory agencies that use internally created policies and procedures that further restrict the operations of private enterprise. Agencies such as the DOT and EPA have tens of thousands of paragraphs of regulations within the Code of Federal Regulations. Every agency also has tens of thousands of notices, bulletins, internal memorandums, bureaucratic processes, etc. that create further restrictions and place enormous burdens on the regulated businesses and private enterprises.
The enormous amount of regulation is already enough to stifle growth, innovation and competition across the US market, but also severely impacts the ability of U.S. based companies to compete abroad. The addition of the bloated regulatory agencies internal processes act as yet another layer of regulation, circumventing the law-making process by allowing unelected bureaucrats to effectively create a secondary set of laws.
The congress should put forth and pass a law expressly prohibiting any federal agency from “legislating by policy or procedure” and make immediately effective a nullification of any such policies that are contradictory to the constitution.
